Terms of Service

1. Operator

DoIt is a service operated by JF Burdet, a natural person domiciled in Switzerland. The infrastructure is hosted in Switzerland.

2. Purpose

DoIt is an online service (SaaS) for task management and collaboration. Access is provided "as-is".

3. Registration and Account

Registration requires a valid email address. The user is responsible for the confidentiality of their access (login email, recovery email). An account may be suspended or deleted in case of abusive use (spam, excessive load, illegal content).

4. User Data

The user retains ownership of their data. The operator commits to implementing reasonable technical measures to protect data (encryption in transit). The user is responsible for maintaining their own backups for critical data through regular manual workspace export.

5. Service Availability

The operator strives to maintain service availability but does not guarantee any uptime rate (no SLA). Maintenance interruptions may occur without notice. The operator reserves the right to discontinue the service with 90 days notice, allowing users to export their data.

Free workspaces and their associated user accounts may be suspended or revoked at any time if their activity or content disrupts the operation of the service.

6. Limitation of Liability

6.1 Free Plan

The free service is provided "as-is", without any warranty of any kind. The operator disclaims all liability for direct or indirect damages resulting from the use of the free service, including but not limited to: data loss, service interruption, loss of profit, or immaterial damage. The free plan user accepts that the absence of financial consideration excludes any claim for damages.

6.2 Paid Plans

In case of damage attributable to a fault of the operator, total liability is limited to the amount actually paid for the annual subscription of the concerned workspace during the 12 months preceding the damaging event.

6.3 Common Exclusions

Regardless of the plan, the operator is in no case liable for indirect damages (loss of profit, business interruption, immaterial damage, consequential data loss).

6.4 User Backups

The service does not constitute a backup solution. The user is solely responsible for maintaining copies of their critical data via the built-in export feature or any other means. This obligation applies to all plans, including paid ones. The operator cannot be held liable for the loss of data that the user could have backed up by their own means.

6.5 Legal Reserve

The above limitations do not apply in cases of wilful misconduct within the meaning of Art. 100 para. 1 of the Swiss Code of Obligations.

6.6 Risk Allocation

The user acknowledges that the price of the service (including its gratuitousness) reflects this risk allocation.

7. Subscriptions and Payments

Some features require a paid subscription, billed per workspace. Subscriptions are automatically renewed unless cancelled before the due date. No refund is granted for the current period in case of early termination, except in case of service discontinuation by the operator.

8. Termination

The user may delete their account at any time. The operator may terminate an account with 30 days notice (90 days for paid accounts). In case of abusive use, termination may be immediate.

9. Applicable Law and Jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is Geneva, Switzerland. The parties shall endeavour to resolve any dispute amicably before any legal proceedings.

10. Modifications

The operator may modify these terms. Significant changes will be notified by email 30 days before their effective date. Continued use constitutes acceptance.
